A local place called Game Store is NOT giving the visual data art book with P4, but they do have it - ON THE SHELF.
They are selling it for 4.95. Did ATLUS make the book available for individual sale?
If not, that is low... grr

and btw- they are not giving it away with the purchase of p4, even if they have extra ones to sell.

First of all, IANAL. That being said, it's written "Not for Sale" at the back of the book, clearly Atlus would not approve what Game Store is doing. However, without a contract, I doubt that what they are doing is illegal as the "Not for Sale" probably doesn't have much legal value, unless they have a contract with Atlus.
It's probably a case of "if you don't agree what company X is doing, take your business elsewhere, probably company Y will be better for what you are looking for".

They also had "not for resale" plastered over almost every copy of Sonic 1, but you can still buy it used. It sucks, but they probably think someone will buy it regardless, so I doubt any level of complaining will change that. Most small businesses like to pull stuff like that.

That's pretty lame. I'm fairly sure it's not legal for them to profit off an item marked as "not for resale." If they were charging more than $5 for it, maybe I'd give them a call. As it is, they're pretty much looking to make enough to buy their lunch. They can laugh all the way to the burger joint if someone really wants the art book enough to pay for it, I suppose.

That's pretty lame if they took all pre-order books and sold them individually. Call them out on it, and say that the label says "Not for resale".

Here's a less "shady" idea of what possibly happened.
That particular GameStop got fewer fulfilled pre-orders than envisioned. They have no idea what to do with the leftover books, so they sell them at a cheaper price than they could on eBay because they don't want to just chuck them.
Yeah, it's probably not what happened, and you should probably call the corporate office/BBB and file a complaint, but hey, if you wanted to give people the benefit of a doubt, there's your benefit of a doubt.

you mean Game Store? I know it's ok, we all got that knee jerk reaction towards Gamestop too.

There was a court case in the US recently that basically said "not for resale" labels are worthless in almost all circumstances. If the OP is in the USA, that's pretty much the story.
